Who You Are Agreeing With

These terms are an agreement between you and Mended, 709 Ponderosa Vlg., Burns, Oregon, United States. You can reach us any time at hello@mended.world. By creating an account or sending a card, you accept these terms.

1. Who May Use Mended

You must be at least 13 years old to use Mended. If you are under 18, you may use Mended only with the involvement of a parent or guardian, who accepts these terms with you. You are responsible for keeping your account details private and for everything done through your account.

2. Your Consent to Receive Texts from Mended

By providing your mobile number and checking the consent box, you accept and authorize Mended to send you text messages about your cards and upcoming milestones, including milestone reminders, delivery confirmations, and account notices. Message and data rates may apply, and message frequency varies based on your activity. You may opt out at any time by replying STOP to any message from Mended, and you may reply HELP for assistance. You also agree to receive these messages in accordance with the Telephone Consumer Protection Act (TCPA) and applicable carrier guidelines.

3. User-Initiated Card Delivery

Mended does not send text messages to your recipients on your behalf. When you purchase a card, Mended prepares the card link and opens your own messaging app (iMessage or Android Messages) pre-populated with the recipient's number and message. You, not Mended, transmit the message from your own device and number. You are solely responsible for ensuring you have the recipient's consent to contact them, and you indemnify Mended against any claims arising from messages you send.

4. Subscriptions, Billing, and Refunds

The "Family Rolodex" membership is an automatically renewing subscription offered on two billing periods, which you choose at checkout: $9.00 per month, or $64.99 per year (a 40% saving on the monthly price). By joining, you authorize us to charge your payment method the amount for the plan you chose today, and then automatically at the start of each following billing period, every month for the monthly plan or once a year for the yearly plan, until you cancel. You may cancel at any time from your settings page, and your access remains active through the end of the billing period you have already paid for. Yearly memberships are not refunded in part for unused months. Due to the immediate delivery and digital nature of the individual cards and add-ons, all one-time purchases ($3.99 base cards, $1.00 media add-ons) are final and non-refundable.

5. Your Content

The words, photos, voice notes, and video clips you add to a card remain yours. You give us permission to store, process, and display them for the purpose of creating your card and letting you and your recipients open it. You confirm you have the right to use whatever you upload.

6. Acceptable Use

You agree not to use Mended to transmit abusive, harassing, threatening, explicit, or illegal content. We reserve the right to terminate accounts, block phone numbers, and remove content that violates this standard without notice or refund.

7. Limitation of Liability

Mended is provided "as is," without warranties of any kind to the fullest extent the law allows. We are not liable for undelivered messages due to carrier filtering, invalid phone numbers, or server downtime. Our total liability in any matter is limited to the amount you paid for the specific service in question. Some states do not allow these limits, in which case they apply to you only as far as the law permits.

8. Governing Law

These terms are governed by the laws of the State of Oregon, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Oregon, and you and Mended agree to the jurisdiction of those courts.

9. Changes to These Terms

We may update these terms from time to time. When we do, we will change the date at the top of this page and tell you directly if the change is significant. Continuing to use Mended after a change means you accept the updated terms.
